1. General information
Welcome to our webshop. These Terms and Conditions apply to the purchase of products and services offered on this website. By placing an order, you agree to be bound by these terms.
2. Products and services
We offer two categories of products and services:
Fine-art prints of underwater photographs
Training courses and educational programs
3. Prices and payment
All prices listed on the webshop are inclusive of VAT.
Payment must be made in full at the time of purchase.
Accepted payment methods: credit card, debit card, and PayPal.
4. Delivery of fine-art prints
Fine-art prints are custom-made and will be shipped within two (2) weeks of order confirmation.
Please ensure that your delivery address is accurate. We are not responsible for delays caused by incorrect delivery details.
5. Training courses
Details about course schedules, locations, and prerequisites will be provided upon enrollment.
Fees for training courses are non-refundable unless the course is canceled by us.
6. Right of withdrawal
Due to the custom nature of fine-art prints, the right of withdrawal is excluded once production has commenced.
For training courses, withdrawal requests must be made at least seven (7) days before the course start date to be eligible for a refund.
7. Intellectual property
All images and course materials are protected by copyright. Reproduction, distribution, or use without prior consent is prohibited.
8. Liability
We are not liable for any indirect or consequential damages arising from the use of our products or services.
Our liability is limited to the amount paid for the product or service in question.
9. Warranty
Unless a written guarantee has been provided, there is generally no warranty for fading or water resistance of printed materials. We clearly indicates when products not specifically designed for outdoor use must be used/placed in enclosed spaces.
The terms and specifications agreed upon at the time of the contract's conclusion represent the technical standard. Minor technical deviations (especially cropping and printed multicolored designs) of the delivered goods compared to the advertised goods are permissible and do not constitute a defect as long as they are acceptable and do not hinder the contractual purpose. Cropped images may, within the usual commercial limits, slightly but not significantly differ from the predetermined dimensions. Small standard color variations may occur if the client's monitor is differently calibrated and not color-accurate. Black-and-white prints may contain slight, customary color deviations due to color printing. Refunds, credit notes, and replacement prints are excluded in this regard, except for deviations exceeding the standard framework.
The statute of limitations for warranty claims for the delivered goods is two years from receipt of the goods. If the customer is a business, the limitation period is one year.
The customer's right to warranty is subject to compliance with their obligation, as long as the customer is a business, to conduct proper inspection.
10. Governing law
These terms and conditions are governed by the laws of Belgium. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Belgium.
